1. The term =E2=80=9Cfloating establishment=E2=80=9D me= ans any floating installation that is normally stationary, e.g. swimming ba= ths, docks, wharves or boat-sheds;
2. The term =E2=80=9Cassembly of floating material=E2= =80=9D means a raft or any construction, assembly or object capable of navi= gation, other than a vessel or floating establishment;
3. A vessel, an assembly of floating material or a floating establishmen= t is =E2=80=9Cstationary=E2=80=9D when it is, directly or = indirectly, anchored or made fast to the shore;
4. A vessel, an assembly of floating material or a floating establishmen= t is =E2=80=9Cunder way=E2=80=9D or =E2=80=9Cproce= eding=E2=80=9D when it is neither directly nor indirectly at ancho= r, made fast to the shore or grounded. For such vessels, floating equipment= or floating establishments under way, the term =E2=80=9Cstop=E2=80=9D appl= ies with respect to the land;
5. The term =E2=80=9Cvessel engaged in fishing=E2=80=9D= means any vessel fishing with nets, lines, trawls or other fishing apparat= us that restrict manoeuvrability, but does not apply to a vessel fishing wi= th trolling lines or other fishing apparatus that does not restrict manoeuv= rability;
6. The term =E2=80=9Cnight=E2=80=9D means the period be= tween sunset and sunrise;
7. The term =E2=80=9Cday=E2=80=9D means the period betw= een sunrise and sunset;
8. The term =E2=80=9Cstate of fatigue=E2=80=9D means a = state occurring as the result of insufficient rest or of sickness, and expr= essed in deviations from the norm in behaviour and reaction speed;
9. The term =E2=80=9Cstate of intoxication=E2=80=9D mea= ns a state occurring as a result of the use of alcohol, narcotics, medicine= s or other similar substances and determined in accordance with national le= gislation and practice;
10. The term =E2=80=9Creduced visibility=E2=80=9D means= conditions in which visibility is reduced owing to e.g fog, haze, snow or = rain;
11. The term =E2=80=9Csafe speed=E2=80=9D means a speed= at which a vessel or a convoy can navigate safely, undertake manoeuvres an= d stop within the distance required by the prevailing circumstances and con= ditions;
12. The term =E2=80=9Cwaterway=E2=80=9D means any inlan= d water open to navigation;
13. The term =E2=80=9Cfairway=E2=80=9D means that part = of the waterway that can actually be used for navigation;
14. The term =E2=80=9Cleft and right banks=E2=80=9D mea= ns the sides of the waterway when moving from the source to the mouth. On c= anals, lakes and broad waterways the term =E2=80=9Cleft and right b= anks=E2=80=9D is assigned by the competent authorities in light of= local conditions. However, it is recommended that for canals, the terms = =E2=80=9Cright=E2=80=9D and =E2=80=9Cleft= =E2=80=9D should be defined as meaning to the right and to the left respect= ively of an observer facing the direction in which the numbers indicated on= successive kilometer markings increase;
14 bis. The designations =E2=80=9Cright-hand side=E2=80= =9D and =E2=80=9Cleft-hand side=E2=80=9D of the waterway o= r fairway are understood to be for an observer facing downstream. On canals= , lakes and broad waterways, the terms =E2=80=9Cright-hand side=E2=80=9D and =E2=80=9Cleft-hand side=E2=80=9D are de= fined by the competent authorities;
15. The term =E2=80=9Cupstream=E2=80=9D means the direc= tion towards the source of the river, including sections where the current = changes with the tide. On canals, the direction shall be determined by the = competent authorities and the term =E2=80=9Cin the direction from point A t= o point B=E2=80=9D shall be used. =E2=80=9CDownstream=E2= =80=9D means the other way around;
16. The term =E2=80=9CADN=E2=80=9D means the Regulation= s annexed to the European Agreement Concerning the International Carriage o= f Dangerous Goods by Inland Waterways;
17. The term =E2=80=9Cnavigation by radar=E2=80=9D mean= s navigation, in conditions of reduced visibility, using the radar;
18. The term =E2=80=9Cinland AIS device=E2=80=9D means = a device that is installed on board of a vessel and is used within the mean= ing of the =E2=80=9Ctracking and tracing in inland navigation=E2=80=9D stan= dard.
